Permit decision pending for transmission pipeline
Hiland Operating, LLC is waiting for application approval for a pipeline that was already constructed in 2010. The 6.5 mile pipeline in Burke County, was constructed without a permit initially, which is a Class A misdemeanor under state law and could carry up to a $200,000 fine. The North Dakota Public Service Commission (PSC) has not made a decision on a penalty, because the company many not have been aware that their pipeline qualified as a transmission line when it was originally constructed. The company brought the un-permitted line to the attention of the PSC in May of 2012. A decision on the permit will be made at the next PSC meeting on December 18.
